General Conditions of Use

1. Purpose of the site

The site allows:

  • consulting advertisements for accommodation to rent for short stays,
  • online booking,
  • secure payment via Stripe,
  • management of reservations and accommodation via a personal space,
  • access to practical information and communication tools.

2. Acceptance of the T&Cs

Use of the site implies full acceptance of these T&Cs.

3. Access to the site

The site is accessible free of charge. Some features require a personal account.

4. Account creation and security

The user is responsible for the confidentiality of his identifiers. Any activity carried out from his account is attributable to him.

5. Regulations applicable to rentals

The site acts as an intermediary connection platform. Each rental company undertakes to comply with French regulations relating to short-term furnished rentals, in particular:

  • the declaration to the town hall for any furnished tourist accommodation (article L.324-1-1 of the Tourism Code),
  • the limit of 120 days per year for the main residence
  • the possible obtaining of an authorization for change of use (notably in Nice, Paris, Lyon, etc.)
  • the declaration of rental income to the tax authorities.

The owner also undertakes to provide accurate information about the accommodation (capacity, equipment, location) and to maintain it in good condition. He is solely responsible for compliance with local regulatory obligations.

The site may ask the owner to confirm the nature of the accommodation (main residence or not) and to provide their declaration or registration number if applicable.

6. Reservation and personal space

  • reservation of accommodation with calendar and availability,
  • access to past or current reservations,
  • management of your profile and personal information,
  • electronic signature of contracts where applicable.

7. Secure payment

Payments are processed via PCI-DSS certified Stripe. The site does not store any banking data. By making a payment, the user accepts the Stripe terms of use.

When making a reservation, a bank imprint can be stored securely via Stripe to allow:

  • deferred validation of payment (2 days before the start of the stay),
  • the management of a possible security deposit,
  • processing refunds or possible disputes.

This information is not stored on our servers but only on Stripe's PCI-DSS certified servers.

Voilà Azure deletes card references (payment identifiers) within 30 days after the end of the stay, unless processing is still in progress (reimbursement, complaint).

In accordance with the GDPR, you may request early deletion of this information by contacting us at contact@bnbazure.fr.

8. Payment management mandate

As an intermediary, Voilà Azure receives mandate from each owner to:

  • collect payments from travelers,
  • charge the agreed service fee,
  • pay the balance back to the owner at the end of the stay or according to the conditions defined.

Funds are held on the platform's Stripe account until scheduled payment.

9. Billing and taxation

  • The owner is responsible for billing the guest.
  • Voilà Azure charges the owner its commission separately.
  • Each owner is responsible for tax reporting their income.

10. Responsibilities

The user is solely responsible for:

  • of its publications and information,
  • compliance with the law applicable to its rentals,
  • of the use of his personal account.

Voilà Azure declines all liability in the event of:

  • regulatory non-compliance of housing,
  • unavailability of the site,
  • input error or user fraud,
  • dispute between user and owner.

11. Intellectual property

All elements of the site are the property of Voilà Azure or its partners. Any reproduction without authorization is prohibited.

12. Personal data

Users' personal data are kept for the period strictly necessary for the purposes for which they were collected, and in accordance with current legislation. Information related to reservations is kept for the legal accounting retention period (10 years), unless otherwise requested by the user in compliance with the legal framework.

13. Cookies

Cookies are used to ensure security, audience measurement and the proper functioning of the site.

14. Account suspension or ad removal

Voilà Azure reserves the right to temporarily or permanently suspend any user account or any advertisement in the event of:

  • non-compliance with these CGU/CGV,
  • fraud or suspicion of fraud,
  • abusive behavior,
  • manifest violation of applicable regulations,
  • damage to the image or security of the platform.

15. Changes

Voilà Azure may modify the T&Cs at any time. Users will be informed.

16. Applicable law

These T&Cs are governed by French law. In the event of a dispute, jurisdiction is given to the courts of the head office of Voilà Azure.

17. Role of the platform

Voilà Azure only provides a service to connect rental companies and travelers. It is neither party to the rental contract, nor responsible for the condition of the accommodation, nor for their regulatory or tax compliance. It only acts as a technical intermediary within the meaning of Regulation (EU) 2022/2065.

18. Illicit Content Reporting (DSA)

In accordance with the Digital Services Regulations (DSA), any user can report illegal or fraudulent content via our contact form or to the following address : contact@bnbazure.fr.

Any report will be analyzed as soon as possible. In the event of a proven breach,Voilà Azure may remove the content or suspend the advertiser.

19. Complaints processing

In the event of a dispute related to the use of the platform, the user can send a complaint to contact@bnbazure.fr.

In accordance with article L.612-1 of the Consumer Code, free recourse to a consumer mediator is possible in the event of persistent disagreement.

20. Bypass

It is prohibited to use the platform to contact a rental company or a traveler with the aim of concluding a rental outside of Voilà Azure. Any circumvention behavior may result in account deletion and prosecution.
